[dropcap]K[/dropcap]yle Zoellner was the suspect accused in the stabbing death of 19-year old Humboldt State student David Josiah Lawson. After five days of preliminary hearings, Zoellner was released due to a lack of physical evidence. Below are the eyewitness accounts of each person called to testify during the hearings.

Lives in Eureka. Uses knives regulary. Has worked for Uniquely Your’s Catering over five years. Has been Kyle’s boss for three yeas. Has over three dozen knives in his professional kitchen, along with two additional boxes of dull knives. Kyle uses his own knives and Bogovic is “very observant” of him and the knives that he owns. Has taught Kyle that knives are strictly a tool and to respect knives. Was shown a picture of the knife found at the crime scene and said “that knife would never be used in a professional kitchen” and he never saw that knife before. Was asked if he would allow the knife that was found at the crime scene to be used in his kitchen and he replied yes. Has looked in Kyle’s knife bag numerous times and he has the same knife bag.
Judges Ruling- Judge Dale Reinholtsen
Said that the only people with motive that night to stab Josiah was Zoellner and the girls he was with but said there was not enough physical evidence and too many contradicting testimonies to show probable cause.
